Distance Sales Agreement

This Distance Sales Agreement (“Agreement”) governs bookings made via the Localexperience.co platform and is presented by Siliconmade ARGE Yazılım Bilişim A.Ş. (“Siliconmade”). By completing a booking, the Traveler accepts this Agreement electronically.

1. Parties and Definitions

Platform: Siliconmade / Localexperience.co
Traveler (Buyer): The natural or legal person who books a service on the Platform.
Guide (Service Provider): Independent person(s) who offer tours/experiences via the Platform.
Service: The tour/experience and related guiding services booked via the Platform.

2. Subject and Scope

This Agreement sets forth the parties’ rights and obligations for the electronic booking, payment, cancellation, and refund of Services on the Platform in accordance with Turkish consumer law. The Platform is not a tour operator; it acts as an intermediary and payment service provider between the Traveler and the Guide.

3. Pre-Information and Consent

Prior to booking, the Traveler is informed about the Service’s key features, total price and taxes, cancellation/refund rules, and execution details, and confirms these electronically. The pre-information form is an integral part of this Agreement.

4. Service Details and Execution

The Service is performed on the date, time, and at the meeting point stated in the booking and as described on the Guide’s listing. The Traveler must review all booking details (location, duration, special conditions). If the Guide is late, absent, or unable to perform, the Cancellation and Refund rules apply.

Under Turkish law, the 14-day right of withdrawal does not apply to leisure services provided on a specific date. Therefore, general withdrawal rights are not available; the Platform’s Delivery and Refund Terms applies instead.

9. Force Majeure

Neither party is liable for failures caused by events beyond reasonable control (natural disasters, war, widespread outages, government actions). Refund handling follows the Force Majeure clause above.

10. Governing Law and Jurisdiction

This Agreement is governed by the laws of the Republic of Turkey. The Courts and Enforcement Offices of Istanbul have jurisdiction.

11. Enforcement

By completing the booking on the Platform, the Traveler is deemed to have accepted this Agreement electronically.
