General Terms of Service

Introduction

This document sets out the general terms and conditions (“Terms”) governing access to and use of the LocalExperience.co online platform (“Platform”), operated by Siliconmade ARGE Yazılım Bilişim A.Ş. (“Siliconmade”), a company established under Turkish law.
LocalExperience provides a technology-based marketplace platform that facilitates connections between independent local service providers (“Locals”) and travelers seeking unique, authentic local experiences (“Travelers”). The Platform acts solely as an intermediary between users and does not organize, provide, or sell any travel, tour, or guide services directly.
By accessing or using the Platform (via website or mobile application), you agree to these Terms. If you do not agree, you must not use the Platform or its services.



Definitions

For the purpose of these Terms:
“Local” refers to an independent individual offering services through the Platform.
“Traveler” refers to a user booking or purchasing an experience via the Platform.
“Platform” refers to the LocalExperience.co website and mobile applications operated by Siliconmade.
“Experience” refers to the independent local activity, tour, or service organized and delivered by a Local.
“Service Fee” refers to the commission retained by LocalExperience for providing technological, marketing, and payment facilitation services.
These definitions apply consistently across all related documents, including the Guest Terms, Host Terms, and Distance Sales Agreement.



Nature of the Platform

LocalExperience is a marketplace technology intermediary, not a tour operator or travel agency under Turkish Law No. 1618.
All experience services are provided independently by Locals. The Platform’s role is strictly limited to:
facilitating communication and bookings between Locals and Travelers,
processing payments through licensed third-party payment providers, and
providing customer support and dispute resolution mechanisms.
LocalExperience is not a party to any service agreement between Locals and Travelers. Each booking constitutes a direct contract between the Traveler (acting as a consumer under Law No. 6502) and the Local (acting as a service provider).



Eligibility and Account Registration

To use the Platform, you must be at least 18 years old.
Users are required to register an account by providing accurate, current, and complete information.
You are responsible for maintaining the confidentiality of your login details and for all actions taken under your account.
LocalExperience may suspend or terminate accounts involved in misleading, abusive, or fraudulent activities.



Platform Conduct and Usage Rules

When using the Platform, you agree to:
Use the Platform only for legitimate purposes related to booking or offering experiences; Avoid sharing contact information, arranging payments, or concluding agreements outside the Platform; Communicate respectfully and avoid any offensive, discriminatory, illegal, or harmful behavior; Not upload or distribute any content that infringes upon third-party intellectual property or privacy rights; Not use the Platform to advertise unrelated services, political content, or adult activities. LocalExperience reserves the right to review, monitor, or moderate all communications and content shared within the Platform to ensure trust, safety, and compliance with these Terms.



Platform Fees and Payments

Registration on the Platform is free of charge. Experience prices displayed are determined by Locals and include all applicable taxes and local fees as required by law. Payments are processed securely through authorized electronic payment partners (such as PayTR or Iyzico). LocalExperience does not accept or handle cash payments. The Platform deducts a service commission from each successful booking to cover technological, marketing, and operational costs. Locals receive payment after the completion of the experience, in accordance with the payout policies of the payment processor. LocalExperience issues an invoice only for the service commission fee. The Local is solely responsible for issuing the service invoice for the experience provided to the Traveler.



Cancellation and Refund Policies

Cancellations and refunds are governed by separate policies available on the Platform:

Local (Guide) Cancellation Policy
These policies specify refund amounts and conditions based on cancellation timing and booking status. LocalExperience’s role is limited to administering refunds according to the applicable policy.
LocalExperience is not responsible for any refund obligations beyond those explicitly defined in the applicable policy. The Platform only executes refund operations on behalf of the Local where required.



Liability and Disclaimer

LocalExperience provides access to the Platform and related technological tools “as is” and “as available.”
While reasonable care is taken to maintain the functionality and integrity of the Platform, LocalExperience does not warrant that the services will be uninterrupted, error-free, or secure at all times.
LocalExperience does not assume any liability for:
the conduct, performance, or quality of services provided by Locals,
errors or omissions in content supplied by users, or
indirect or consequential losses, including loss of profit or data.
LocalExperience does not verify, endorse, or guarantee any description, license, or qualification of Locals.
In any case, LocalExperience’s total liability is limited to the amount of the service commission received for the specific transaction in question.



Data Protection and Privacy

All personal data is processed in compliance with the Turkish Personal Data Protection Law No. 6698 (KVKK) and the EU General Data Protection Regulation (GDPR) where applicable. User data is used solely for:
facilitating bookings and communication,
ensuring payment processing, and
improving platform security and performance.
Personal data of Travelers and Locals may be shared mutually only to the extent necessary for booking and service delivery.

Intellectual Property

All intellectual property rights to the Platform, including trademarks, logos, designs, text, and software, belong to Siliconmade or are used under license.
Users retain ownership of their uploaded content but grant LocalExperience a limited, non-exclusive right to use such materials for service display, marketing, and promotional purposes, subject to KVKK limitations.



Modification and Termination

LocalExperience reserves the right to modify or update these Terms, the Platform’s features, or any part thereof at any time. Updates will be published on the Platform with the effective date clearly indicated. Continued use after such updates constitutes acceptance. LocalExperience may suspend or terminate a user’s access without prior notice in cases of:
breach of these Terms,
fraudulent activity, or
abuse of the Platform.



Governing Law and Jurisdiction

These Terms are governed by Turkish law, particularly Law No. 6502 on Consumer Protection and Law No. 6563 on Electronic Commerce.
Any dispute arising from the use of the Platform shall be submitted to the Istanbul Central (Çağlayan) Courts and Enforcement Offices.
